1. Acceptance of Terms

By accessing or using Kindled ("the Service"), operated by Kindled AI ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kindled is an AI-powered marketing automation platform that provides social media management, email newsletters, review response drafting, cold outreach, and AI customer support chatbots for small businesses.

3. Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials.

You must be at least 18 years old and have the authority to bind your business to these terms.

4. Subscriptions & Payment

Kindled offers paid subscription plans billed monthly or annually via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.

Free trials, if offered, convert to paid subscriptions automatically unless cancelled before the trial ends.

5. Acceptable Use

You agree not to use Kindled to:

• Send spam or unsolicited bulk email in violation of CAN-SPAM or applicable laws
• Generate content that is illegal, defamatory, harassing, or fraudulent
• Impersonate another person or business
• Attempt to access other users' accounts or data
• Reverse-engineer, scrape, or abuse the platform or its APIs

We reserve the right to suspend or terminate accounts that violate these terms.

6. AI-Generated Content

Content generated by Kindled's AI is provided as a tool. You are responsible for reviewing and approving all content before it is published or sent on your behalf.

We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content. You are solely responsible for content posted to your accounts or sent to your contacts.

7. Email & Outreach Compliance

You are responsible for ensuring that your use of Kindled's email and outreach features complies with all applicable laws, including CAN-SPAM, GDPR, and CASL.

You must only send emails to contacts who have opted in or with whom you have a legitimate business relationship. Kindled includes unsubscribe links in all marketing emails.

8. Intellectual Property

You retain ownership of your business data, content, and contact lists. Kindled does not claim ownership of content generated for your account.

The Kindled platform, brand, and underlying technology remain our intellectual property.

9. Limitation of Liability

Kindled is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, data loss, or reputation damage from AI-generated content.

10. Termination

We may suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time by contacting support.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
